A. Financial Conflicts of Interest Disclosure Requirements.

1. Elected Officials shall publicly disclose any of the following interests relating to an individual or business with which they are associated, or with which they propose to be commercially engaged. For the purposes of this chapter, an interest shall be considered any of the following:

a. Employment with said business, as defined in Section 6-104;

b. A business relationship, as defined in Section 6-104, with said business;

c. An economic interest, other than the holding of common stock in said business.

2. Public disclosure shall be made to the Tribal Council at a regularly scheduled Tribal Council meeting within thirty (30) days of the time the elected official is sworn in, or acquires or learns of an interest as defined in subsection (A)(1) of this section. This public disclosure shall include the name of the business an individual is commercially engaged with, or proposes to be commercially engaged with, and the nature of the interest.

3. Failure to disclose information as required under this subsection (A) shall be a violation of this chapter.

B. Gift and Honorarium Disclosure Requirements.

1. An elected official or tribal official shall report any gift or honorarium in writing to the Vice-Chairperson if the value of the gift or honorarium exceeds a fair market value of one hundred dollars ($100.00). A report of a gift received in the course of official duties or appearances is not necessary if the gifts are:

a. Conveyed during a traditional tribal ceremony or wedding.

b. Conveyed during an official ceremony of Wilton Rancheria.

c. Conveyed during a traditional gathering.

2. A gift or honorarium is not required to be reported under this subsection (B) if the gift or honorarium is received in the personal or individual capacity of the elected official or tribal official.

3. Failure to report a gift or honorarium as required under this subsection (B) shall be a violation of this chapter.

C. Ethics Training.

1. Elected officials and tribal officials shall review this chapter or, if applicable, complete the Tribe’s ethics training, within sixty (60) days of assuming their positions.

2. Elected officials and tribal officials shall complete the Tribe’s ethics training course, or review this chapter, on an annual basis.

3. Elected officials and tribal officials will report and certify, within thirty (30) days, to the Vice-Chairperson upon completion of the training course or review of this chapter as required under this section. (Res. 2021-43; Res. 2019-46; Res. 2016-36; Res. 2015-2)
