A. Response Options. A person who is issued a citation shall respond by:

1. Paying the fine within thirty (30) days from the date the citation is served; or

2. Petitioning the Tribal Court for a hearing to contest the citation in accordance with the procedures outlined herein.

B. Request for Hearing. Any person who disagrees with a citation issued under this chapter may contest the citation with the Tribal Court.

1. A request for hearing must be made by petition within thirty (30) days of the issuance of the citation.

2. A hearing shall be scheduled within thirty (30) days from the Tribal Court’s receipt of a request for hearing. The Tribal Court shall provide a written notice of hearing to the petitioner requesting the hearing, which shall state the date, time and place of the hearing and shall be served at least fifteen (15) days prior to the date of the hearing.

C. Tribal Court Decision. After considering all the testimony and evidence submitted at the hearing, the Tribal Court shall issue a written decision to uphold or dismiss the citation and the reasons for that decision. (Res. 2022-47 (Exh. A); Res. 2020-92; Res. 2020-07. Formerly 4-704)
