A. The Chairperson is authorized to enforce this chapter and all implementing rules and regulations, including the authority to establish, by written policy and procedures, requirements or qualifications for Tribal Peace Officers, and to serve as a Peace Officer in the event of a declaration of a tribal state of emergency or in the absence or shortage of appointed Tribal Peace Officers.

B. The Chairperson is authorized to select, hire, and supervise one (1) or more persons to serve as Tribal Peace Officer(s) who shall have the following powers and responsibilities:

1. To exercise all powers necessary, reasonable and proper to accomplish the purposes of this chapter.

2. To investigate violations of this chapter.

3. To coordinate any investigation with state or federal law enforcement agencies or personnel.

C. The Chairperson shall make such reports as may be requested or required by the Tribal Council on actions taken to enforce the provisions of this chapter.

D. The Chairperson or his or her designee is authorized to file any action in Tribal Court to enforce the provisions of this chapter; provided, that under no circumstances may a Peace Officer waive the Tribe’s immunity from suit without express, written and specific consent of the Tribal Council.
