A. If the Court finds that the cited person more likely than not committed a violation, the Court shall enter any appropriate civil penalty authorized by applicable law, taking into account the severity of the violation and the cited person’s record of prior violations.

B. If necessary, the Court may schedule a separate hearing to determine the appropriate civil penalty for the violation. All decisions shall be entered in writing and contain the requirements and deadlines to satisfy a civil penalty. (Res. 2020-61)
