Privileged communications between the Tribe’s legal counsel and the Tribal Council or individual members of the Tribal Council will be protected and not disclosed. The Tribe’s legal counsel shall inform members of the Tribal Council as to what communications are considered privileged. Written privileged documents prepared by legal counsel will be clearly marked as such. Nondisclosure of privileged communications applies to the Chairperson, Vice-Chairperson, members of the Tribal Council, and all tribal employees privy to such communications. Without prior approval of the Chairperson, in consultation with the Tribe’s legal counsel, any document labeled as confidential by the Tribe’s legal counsel will not be disclosed in open meetings as part of the Tribal Council agenda or to anyone outside of the Tribal Council.
