A. The rate of pay for the Chairperson and Vice-Chairperson shall be determined in collaboration with the Tribal Council.

1. In order to establish a rate of pay commensurate with their respective role’s duties, expectations, and governing laws, the Chairperson and/or Vice-Chairperson shall be expected to provide the following:

a. Full employment career resume;

b. Proof of education/work experience;

c. Organizational plan and timeline of goals; and

d. Rationale for requested rate of pay.

2. Chairperson and Vice-Chairperson rates shall be established each year in the Tribe’s budget.

B. At any time after the determination of a rate of pay for the Chairperson or Vice-Chairperson in accordance with this section, the Tribal Council may, following a showing of good cause, suspend, terminate, or reduce any compensation of the Chairperson or Vice-Chairperson by a vote of at least five (5) members of Tribal Council; provided, however, that the suspension, termination, or reduction shall not affect any compensation earned prior to the vote. Such a vote is considered a final decision and is directly appealable to the Wilton Rancheria Tribal Court or, if the parties agree, to the Traditional Court. The decision of the Tribal Court is appealable to the Wilton Rancheria Appellate Panel.

C. For the purposes of suspending, terminating, or reducing the compensation of the Chairperson or Vice-Chairperson pursuant to this section, any of the following shall be evidence of good cause:

1. Gross negligence of duties;

2. Egregiously poor work performance;

3. Lack of trust on behalf of the Tribal Council supported by articulable facts demonstrating a lack of trustworthiness; or

4. Any affirmed findings of ethics violations in accordance with the Ethics Act.

D. The suspension, termination, or reduction of compensation shall not affect the term of the elected official’s elected office in any way. Removal of an elected official from elected office may only be carried out as provided for in the Constitution and those laws specifically implementing the removal of elected officials from elected office.
